Terms of Service

These Terms of Service ("Terms") govern your access to and use of hyperoptixusa.com (the "Site"), operated by HyperOptix ("HyperOptix", "we", "us", or "our"). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site. Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and share information you provide through the Site's forms. You also accept these Terms, and our Privacy Policy, each time you submit a form on the Site (for example, a quote request, dealer application, or warranty claim); a notice to this effect appears near each form's submit button.

Eligibility

The Site is intended for a general, adult audience. You represent that you are at least 18 years old (or the age of majority where you live) and able to agree to these Terms. The Site is not directed to children under 13, and we do not knowingly collect their personal information. See our Privacy Policy for details.

Use of the Site

You agree not to: violate any law or these Terms; infringe intellectual-property or privacy rights; submit false information or another person's information without authorization; upload viruses or malicious code; use bots, scrapers, or automated means to access or harvest data; probe, overload, or breach the Site's security; reverse-engineer the Site or the tint simulator; frame or mirror the Site; or misuse the forms, including spam or fraudulent quote, dealer-application, or warranty submissions.

Product Information & the Tint Simulator

Product descriptions, specifications, shade options, and performance figures on the Site are provided for general informational purposes and may be updated at any time. Performance figures such as "100% UV rejection" and "up to 96% heat rejection (TSER — Total Solar Energy Rejected)" reflect manufacturer specifications from controlled laboratory testing and apply to specific films and shades. "Up to" denotes the maximum achievable under optimal conditions; actual results vary by product, shade, glass type, vehicle, and environmental conditions, and are not guaranteed for your vehicle.

The tint simulator produces an approximate visual preview only; actual appearance varies with your vehicle, glass, lighting, and installation, and previews do not guarantee an exact real-world result. Any image you upload to the tint simulator is processed entirely within your own browser, on your device. It is not uploaded to, transmitted to, or stored by HyperOptix, and we never receive a copy of it. Please confirm final specifications, shade selection, pricing, and availability with an authorized HyperOptix dealer before purchase.

Window-Tint Laws Are Your Responsibility

Automotive window-film (VLT / darkness) laws vary by state, province, and locality and can change. You are solely responsible for selecting a shade and installation that comply with the laws applicable to your vehicle and location. HyperOptix and its dealers are not responsible for citations, fines, failed inspections, or other consequences resulting from a shade or installation that does not comply with local law. When in doubt, check your local regulations or ask your installing dealer before choosing a shade.

Dealers, Quotes & Purchases

HyperOptix products are sold and installed through independent, authorized dealers. The Site does not process sales or payments. Any quote, price, or estimate is provided by the applicable dealer, is not binding until confirmed by that dealer, and does not create a contract of sale with HyperOptix.

Warranty

HyperOptix films are covered by a limited warranty (10-year on HyperCore and HyperPro, and lifetime on HyperNano), as described on our Warranty page and in the official warranty documentation. That documentation governs warranty coverage; nothing on the Site creates any additional warranty.

Forms & Submissions

When you submit information or content to us through a form (for example, a review, photo, or warranty-claim attachment), you confirm it is accurate and that you have the right to share it, and you grant HyperOptix a non-exclusive, worldwide, royalty-free license to use approved submissions to operate and promote the brand, with credit where appropriate. This does not apply to images you use in the tint simulator, which are processed on your device and are never uploaded to us. Do not submit content that is unlawful, infringing, or that you do not have the right to share.

Intellectual Property

The HyperOptix name, logo, product names, website content, and the tint simulator are owned by HyperOptix or its licensors and are protected by intellectual-property laws. You may not copy, reproduce, modify, distribute, or create derivative works from them without our prior written permission. All other trademarks are the property of their respective owners.

Third-Party Links

The Site may link to third-party websites or services (for example, social media or a review platform). We are not responsible for the content, policies, or practices of those third parties.

Disclaimers

THE SITE AND ALL CONTENT, INCLUDING THE TINT SIMULATOR, ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, HYPEROPTIX DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, secure, error-free, or free of harmful components. Some jurisdictions do not allow the exclusion of certain implied warranties, so some of the above exclusions may not apply to you.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, HYPEROPTIX AND ITS AFFILIATES, OFFICERS, AND EMPLOYEES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SITE. HYPEROPTIX'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100). Products and installation are provided by independent dealers under their own terms; HyperOptix is not responsible for a dealer's products, workmanship, or conduct. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you, and nothing in these Terms limits liability that cannot be limited under applicable law.

Indemnification

You agree to indemnify, defend, and hold harmless HyperOptix and its affiliates, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Site, your submissions, or your violation of these Terms or of any law or third-party right.

Termination

We may suspend, restrict, or terminate your access to the Site at any time, with or without notice, for any reason, including suspected violation of these Terms. The Intellectual Property, Forms & Submissions, Disclaimers, Limitation of Liability, Indemnification, and Governing Law sections survive termination.

Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. You agree that any dispute arising from these Terms or the Site will be resolved in the state or federal courts located in California.

General

These Terms, together with our Privacy Policy and any warranty documentation, are the entire agreement between you and HyperOptix regarding the Site and supersede any prior understandings. If any provision is held unenforceable, it will be limited or severed to the minimum extent necessary and the remaining provisions will remain in effect. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. We may modify or discontinue the Site or any feature (including the tint simulator) at any time without liability.

Copyright Complaints

To report content you believe infringes your copyright, email customerservice@hyperoptixusa.com with the information required under 17 U.S.C. § 512, including identification of the copyrighted work, the material at issue and its location, and your contact information.

Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
